The North Carolina Court of Appeals recently favorably decided a case that will assist homeowners all over the state whose property lies in highway corridors designated by the State Department of Transportation. The Court of Appeals held that properties located within these corridors, which has been designated to be used for future development of highways pursuant to the North Carolina Map Act, constitutes a taking of your property. This is called inverse condemnation. Many people have had their land held in limbo for years in this way, particularly those affected by the Fayetteville Outer Loop in Cumberland County and Robeson County.
